Terms and Conditions

These terms govern your use of EMDR Digital. By accessing or using the platform, you agree to be bound by these terms.

1. Definitions

  • "Platform" refers to the EMDR Digital web application and associated services.
  • "Therapist" or "You" refers to the licensed mental health professional with an account.
  • "Patient" refers to the individual who joins a therapy session via a therapist's link.
  • "We", "Us", or "EMDR Digital" refers to the operator of the platform.

2. Early Access Program

EMDR Digital is currently in early access. This means:

  • Features may change, be added, or removed without prior notice
  • Service interruptions may occur for maintenance or updates
  • We welcome your feedback to help improve the platform

During early access, the platform may be offered free of charge or with special conditions for founding therapists. Specific pricing will be communicated before any paid features are introduced.

3. Service Description

EMDR Digital provides:

  • Secure video calls with integrated bilateral stimulation (visual and auditory)
  • Optional session audio recording with automatic transcription
  • AI-powered session analysis and report generation
  • Patient record management and session history
  • Collaborative canvas and clinical note-taking tools

EMDR Digital is a clinical support tool. It does not replace professional judgment, diagnosis, or treatment decisions. The therapist retains full clinical responsibility.

4. Account Responsibilities

As a therapist using EMDR Digital, you agree to:

  • Be a licensed mental health professional authorized to practice in your jurisdiction
  • Keep your account credentials secure and confidential
  • Accept responsibility for all activity under your account
  • Provide accurate registration information
  • Comply with all applicable laws and professional ethics codes

5. Patient Data & Clinical Responsibility

You, as the therapist, are the data controller for your patients' clinical data. EMDR Digital processes this data on your behalf as a data processor.

You are responsible for:

  • Obtaining appropriate informed consent from your patients for data processing and recording
  • Ensuring your use of the platform complies with professional and legal obligations
  • Maintaining the confidentiality of patient records in your account
  • Informing your patients about how their data is processed on this platform

6. Recording & AI Analysis

Session recording is optional and requires both therapist initiation and patient consent.

When enabled:

  • Only audio is recorded — video is never recorded
  • Recordings are transcribed using a locally-hosted speech recognition model
  • Transcripts are analyzed by AI (Google Gemini, hosted in the EU) to generate reports
  • Audio recordings are automatically deleted after 90 days
  • You can delete recordings, transcripts, and analysis at any time

7. Intellectual Property

You retain full ownership of all content you create, including patient records, clinical notes, and modifications to generated reports.

EMDR Digital retains ownership of the platform software, design, and technology. AI-generated reports are provided as a service — you own the output and may edit, export, or delete it.

8. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose
  • Attempt to access other users' data or accounts
  • Interfere with the platform's operation or security
  • Store or transmit malicious content through the platform
  • Resell, sublicense, or redistribute access to the platform

9. Limitation of Liability

During early access, the platform is provided "as is". To the maximum extent permitted by law:

  • We do not guarantee uninterrupted or error-free service
  • We are not responsible for clinical decisions made using the platform
  • AI-generated reports are assistive tools and must be reviewed by the therapist
  • Our liability is limited to the amount paid for the service in the 12 months preceding the claim

Nothing in these terms limits liability for fraud, gross negligence, or death or personal injury caused by negligence.

10. Account Termination

You may delete your account at any time. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

We may suspend or terminate accounts that violate these terms, with reasonable notice where possible.

11. Changes to These Terms

We may update these terms to reflect changes in our service or legal requirements. Registered users will be notified of significant changes via email with reasonable notice. Continued use after changes take effect constitutes acceptance.

12. Governing Law

These terms are governed by the laws of Spain. Disputes shall be submitted to the courts of Madrid, Spain, without prejudice to mandatory consumer protection provisions in your country of residence.
